Terms of Use — WispDay

1. The app

WispDay is a private journaling and diary application. It lets you write and organize entries with photos, moods, drawings, voice memos, reflections, collections, goals, habits, and related features. Core features, including the app's security and encryption features, are available for free. Certain premium features are available through a paid subscription ("Wispday Pro").

2. Accounts

You can use WispDay without an account. An account is required only to enable backup and sync across devices.

If you create an account:

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

You agree to provide accurate information and to keep it current.

Your content is protected by encryption keys that exist only on your device and are never sent to us. We never hold, store, back up, or have access to your keys, and we never will. This is a deliberate part of WispDay's design and is what allows us to promise that we cannot read your content.

As a direct consequence, if you lose your encryption keys, your credentials, or access to your device — and you do not have your own backup — your content cannot be recovered by anyone, including us. We have no ability to reset, restore, decrypt, or recover your content, because we do not possess the means to do so. There is no "forgot password" path that can recover encrypted content for you.

You are solely responsible for safeguarding your keys, credentials, and any backups, and for any loss of content that results from losing them. By using WispDay's account, backup, and sync features, you acknowledge and accept this risk.

3. Your content

You retain all rights to the content you create in WispDay ("Your Content"). We do not claim ownership of Your Content.

Because your content is encrypted on your device and our systems cannot read it, we do not monitor, review, or moderate Your Content. You are solely responsible for what you create and store in the app, and for ensuring you have the right to store any content (for example, photos) you add.

You grant us only the limited, technical permission necessary to store and sync Your Content in encrypted form so the app can function (for example, transmitting and storing the encrypted data, and syncing it across your devices). This permission exists solely to provide the service to you and for no other purpose.

WispDay has no public or social sharing features; Your Content is not shared with other users or made public by the app.

4. Acceptable use and your responsibility for your conduct

WispDay is a private space for your own personal use. You are solely responsible for how you use the app and for all content you create, store, or process with it. You agree to use WispDay only for lawful purposes and in compliance with all laws that apply to you.

You agree not to:

Use WispDay for any unlawful purpose, or to store, create, or process any content that is illegal or that you are not legally permitted to possess or handle.

Use the app in furtherance of any illegal activity.

Attempt to interfere with, disrupt, overload, or compromise the app or our servers.

Attempt to reverse engineer, decompile, or circumvent the app's security measures, except to the extent this restriction is prohibited by applicable law.

Attempt to access another user's account or data.

Use the app to infringe the rights of others.

We do not monitor, review, or control your content or your conduct. Because the app is designed so that your content is encrypted and not readable by us, we have no ability to see what you store and we do not screen it. You — not the developer — are entirely responsible for your own actions and content within the app, and for ensuring that your use complies with the law. The developer is not responsible or liable for any user's conduct, content, or misuse of the app.

The app's security and encryption features are intended to protect the privacy of ordinary users. Providing strong privacy protection does not constitute endorsement or facilitation of any unlawful use, and any such use is a violation of these Terms and is solely the responsibility of the person who engages in it.

We may suspend or terminate access that violates these Terms or that threatens the security or integrity of the service.

5. Cloud Intelligence

WispDay offers an optional Cloud Intelligence feature that is on by default. If you enable it, certain entry text is processed as described in our Privacy Policy. By enabling Cloud Intelligence, you consent to that processing. You may disable it at any time, after which no entry text is transmitted for that purpose. Outputs generated by Cloud Intelligence (such as suggested goals or extracted themes) are provided to assist you and may not always be accurate or complete; you should use your own judgment.

6. Subscriptions and payments

WispDay is free to download and use, including all security features. "Wispday Pro" is an optional auto-renewing subscription that unlocks premium features.

All purchases are processed by Apple through in-app purchase, subject to Apple's terms. We do not process or store payment information.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription in your Apple Account settings. Deleting the app does not cancel a subscription.

Except where required by law or by Apple's policies, payments are non-refundable. Refund requests are handled by Apple.

Prices and features may change; we will communicate material changes as required.

7. Intellectual property

The WispDay app, including its name, design, branding, and software (but excluding Your Content), is owned by the developer and protected by intellectual property laws. These Terms do not grant you any right to our trademarks, branding, or software beyond the limited right to use the app as intended.

8. Third-party services

WispDay relies on certain third-party services to function, including Apple (for distribution, payments, and on-device system features), cloud hosting and storage providers (for encrypted data), a weather service, and — only if you enable Cloud Intelligence — an AI processing provider. Your use of the app may also be subject to the terms of those providers where applicable. We are not responsible for third-party services we do not control.

9. Disclaimers

WispDay is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or completely secure, or that any data will always be available or recoverable.

While we design WispDay to keep your content private and encrypted, no method of electronic storage or transmission is perfectly secure, and we cannot guarantee absolute security.

You are responsible for maintaining your own backups and access. Given the app's design, we may be unable to recover lost content.

10. Limitation of liability

To the fullest extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or content, arising from or related to your use of (or inability to use) WispDay. The developer is also not liable for any user's own conduct or content, or for any misuse of the app by you or any third party. To the extent any liability cannot be excluded, it is limited to the amount you paid for the app or subscription in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using WispDay at any time and may delete your account. We may suspend or terminate access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of WispDay after changes take effect means you accept the updated Terms.
